The circular guiding the procedures for issuing visas and temporary residence cards and extention of temporary residence cards to foreigners in vietnam within the jurisdiction of ministry of foreign affairs

Ministry of Foreign Affairs promulgated the Circular No 04/2016/TT-BNG dated June 30th, 2016 providing guideline for procedures for issuing visas and temporary residence cards, and extension of temporary residence cards to foreigners in Vietnam within the authority of the Ministry. This Circular has come into force from September 01st, 2016.

1. Visa symbols - Regulated entities

Foreigners in Vietnam within the authority of the Ministry of Foreign Affairs as stipulated in clauses 1, 2, 3 and 4, Article 8 of the Law on Entry, Exit, Transit and Residence of Foreigners in Vietnam (hereinafter refer to as " Law on Entry and Exit") are classified into the following entities:

1.1. NG1 –members of delegations invited by Secretary General of Vietnam's Communist Party, President of Vietnam, Chairman of Vietnam's National Assembly, Prime Minister of Vietnam. (Clause 1, Article 8)

1.2. NG2 - members of delegations invited by Standing member of the Secretariat of Vietnam's Communist Party, Vice President of Vietnam, Vice Chairmen of Vietnam's National Assembly, Deputy Prime Ministers of Vietnam, Chairman of Vietnam Fatherland Front Committee, Chief Judge of Supreme People's Court of Vietnam, Prosecutor General of Supreme People's Procuracy of Vietnam, Auditor General of State Audit Office of Vietnam; members of delegations being at the same rank with and invited by Ministers and similar ranks, Secretary of Party Committee and Chairman of People's Council and People's Committee of centrally-administered localities. (Clause 2, Article 8)

1.3. NG3 - members of diplomatic missions, consular offices, representative offices of international organizations affiliated to the UN, representative offices of intergovernmental organizations and their spouses, children under the age of 18, and housemaids during their term of office. (Clauses 3, Article 8).

1.4. NG4 - people who come to work with diplomatic missions, consular offices, representative offices of international organizations affiliated to the UN, representative offices of intergovernmental organizations, visitors of members of these organizations. (Clauses 4, Article 8).

2. Authority of various agencies to issue visas and temporary residence cards and extend temporary residence cards

According to the Circular, authority of various agencies to issue visas and temporary residence cards and extend temporary residence cards to foreigners in Vietnam within the authority of Ministry of Foreign Affairs as stipulated in Clauses 1, 2, 3 and 4, Article 8 of the Law on Entry and Exit is prescribed as follows:

2.1. Consular Department affiliated to Ministry of Foreign Affairs:

Issuing visas and temporary residence cards and extension of temporary residence cards to foreigners specified in Clauses 1, 2, 3 and 4 of Article 8 of the Law on Entry and Exit.

2.2. Directorate of State Protocol affiliated to Ministry of Foreign Affairs:

Issuing temporary residence cards to those specified in Clause 3, Article 8 of the Law on Entry and Exit (except for members of consular offices in Ho Chi Minh City, their spouses, under-18-year-old children and accompanied housemaids during their term of office).

2.3. Department of Foreign Affairs of Ho Chi Minh City affiliated to Ministry of Foreign Affairs:

Issuing visas, extension of temporary residence cards to foreigners specified in Clauses 1, 2 and 4, Article 8 of the Law on Entry and Exit from Quang Nam province and Da Nang city to the South of Vietnam.

Issuing temporary residence cards to foreigners as members of consular offices in Ho Chi Minh City, their spouses, under-18-year-old children and accompanied housemaids during their term of office.

2.4. Vietnam's diplomatic missions abroad:

Receiving applications for visa and transferring them to Consular Department or Department of Foreign Affairs of Ho Chi Minh City for their processing within their power.

Issuing visas to foreigners according to the reports of Consular Department or Department of Foreign Affairs of Ho Chi Minh City.

3. Procedures for processing visa applications/requests

The organization or agency that guarantees/invites foreigners to Vietnam  as what is specified in Clauses 2 and 3, Article 15 of the Law on Entry and Exit shall directly submit visa applications or requests to the Consular Department or Department of Foreign Affairs of Ho Chi Minh City.

The Ministry of Foreign Affairs of the home country of foreigners specified in Clauses 1, 2, 3 and 4 of Article 8 of the Law on Entry and Exit shall submit visa applications or requests to Vietnam's diplomatic missions abroad for their transferring them to the Consular Department or Department of Foreign Affairs of Ho Chi Minh City.

A visa application/request includes:

a) A diplomatic note or written request for visa issue which specifies the foreigner's personal information such as full name, date of birth, nationality, gender, passport number and symbol, date of issue and expiry of passport, occupation and position, purpose of entry, effective duration of visa, type of visa and his/her place for visa receipt.

b) In case the foreigner comes to Vietnam for visiting members of diplomatic missions in Vietnam, a copy of ID of the above-mentioned members must be added to the application/request.

c) If the foreigner is a contractual staff of a diplomatic mission in Vietnam, a copy of the valid employment contract must be added to the application/request.

d) In case the foreigner belongs to supplemented personnel of diplomatic missions in Vietnam, a diplomatic note of this issue of the Ministry of Foreign Affairs of his/her home country must be added to the application/request.

4. Procedures for extension of temporary residence

Foreigners granted visas of NG1, NG2 or NG4 types and wishing to have their residence duration extended shall request their guaranteeing organizations to submit applications for this extension to the Consular Department  or  Department of Foreign Affairs of Ho Chi Minh City.

An application for this extension includes:

a) A diplomatic note or written request for extension of temporary residence which specifies the foreigner's personal information such as full name, date of birth, nationality, gender, passport number and symbol, date of issue and expiry of passport, occupation and position, purpose of entry, extended duration and a request for a new visa (if any).

b) A foreigner's passport that is valid for more than 30 days from the date of application for extension.

c) An application form for visa and extension of temporary residence card (using form NA5 issued together with the Circular No. 04/2015/TT-BCA) countersigned and sealed by the guaranteeing organization.

d) 01 photo of ID of members of diplomatic missions in Vietnam issued by the Directorate of State Protocol or Department of Foreign Affairs of Ho Chi Minh City in case the foreigner comes to Vietnam for visiting these people.

e) 01 copy of the valid employment contract if the foreigner is a contractual staff of a diplomatic mission in Vietnam.

5. Procedures for application for temporary residence cards

The organization guaranteeing for foreigners prescribed in Clause 3, Article 8 of the Law on Entry and Exit shall submit an application for temporary residence card to competent authorities stipulated in Article 3 hereof.

An application for temporary residence card includes:

a) A diplomatic note of temporary residence card request of a diplomatic mission in Vietnam which specifies full name, date of birth, nationality, passport number and symbol, occupation and position of the foreigner (refer to form NA6 issued together with the Circular No.04/2015/TT-BCA);

In case of a replacement/supplement of officials of diplomatic missions in Vietnam, the diplomatic note shall specify full name and position of the replaced ones.

b) An application form for temporary residence card (using form NA8 issued together with the Circular No.04/2015/TT-BCA) countersigned by competent authorities and sealed by the diplomatic mission in Vietnam;

c) A valid passport of the foreigner;

d) In case the foreigner belongs to supplemented personnel of the  diplomatic mission in Vietnam, a  diplomatic note of this issue of the Ministry of Foreign Affairs of his/her home country is required, besides documents specified above.
